Peter sold 50 classic cars to Sarah in Auckland New Zealand, f.o.b. New York; 20 classic cars to Susan c.i.f. Manila Philippines; 65 classic cars ex mv Marine to Steve c.i.f. Taipei and 48 classic cars c.f.r. to Yuki in Tokyo Japan. All cargo was shipped aboard the mv Marine, sailing from New York to Auckland via Manila, Taipei & Tokyo on the 20th January and promptly consigned shipping documents to Steve that day. Each classic car was shipped with a lot number assigned to it. The four bills of lading issued stated the correct number of classic cars but did not identify which classic cars were covered by each document. On the 5th February the mv Marine dared to go where no other vessel has dared to go before and was lost without trace. Hearing reports of the loss of the vessel Peter phoned Sarah and Susan respectively stating that classic cars 1-50 were allocated to Sarah and 51-70 were to be allocated to Susan and then consigned their documents to them. Sarah and Susan refuse to pay on endorsement of their bills of lading claiming that Peter cannot endorse the documents since risk did not pass before the loss since the goods had not been appropriated to the contract at the time of the loss. They both complain that if they had been provided with exact details of the date of shipment they could have taken out additional insurance cover in respect of cargo on board vessels that dare to sail where no other vessel has dared to go before. Peter has now heard that Steve, who has not paid her yet, has gone walkabout and has disappeared without trace. Yuki who has not paid yet either has apparently run off with a Hollywood actor and has been linked with a major financial crime investigation.
